Czech Republic's 'Trumpist' PM-Elect Declines to Divest Corporate Holdings During Ethical Dispute

Andrej Babiš, the self-proclaimed tycoon who won last month's Czech election, has refused to offload his vast corporate assets, while insisting he will resolve a conflict of interest that could block him from assuming the role of prime minister.

Stance on Business Holdings

Babiš, whose ANO party came first in the autumn election but did not secure a majority in parliament, declared in a online statement that he would not sell his Agrofert group, which operates in agriculture, food production, and chemicals.

“I have repeatedly said I will never sell Agrofert. I have consistently stated I will address the conflict of interest in accordance with Czech and European laws,” the billionaire remarked. “This is not like selling a roll in a bakery.”

Head of State's Demand

The Czech president, Petr Pavel, stated that the 71-year-old political figure must publicly explain how he will remove ethical conflicts stemming from his business activities before assuming the role of prime minister.

The Czech constitution “explicitly requires the head of state to take into account the possible emergence of a ethical issue and the possibilities for its resolution” when selecting cabinet members, the presidential administration explained.

The head of state “expects clarity in what specific way Andrej Babiš will fulfil his statutory duties”, the statement said, noting that Pavel was prepared to designate Babiš as prime minister “without delay” once the issue was settled.

Business Operations and Legal Concerns

Babiš's several hundred companies, mostly under the Agrofert umbrella, operate in the nation and other regional countries, benefiting from substantial funds in national and EU agricultural and other subsidies, as well as government deals.

Under national legislation, government ministers cannot receiving public aid or agreements. The anti-corruption organization Transparency International has indicated that to avoid a conflict of interest, Babiš must either sell, refuse public contracts, or stay out of public office.

Previous Tenure and Present Intentions

Babiš affirmed he would “abide by the laws” if selected as prime minister, but declined to detail how in beforehand because the matter was “an highly personal and personal matter for me, and the media will invariably criticise me regardless”.

During his first term as premier, from 2017 to 2021, Babiš faced multiple court cases and an European inquiry over potential conflicts of interest. He temporarily moved his assets into fiduciary arrangements, while retaining some influence over them.

A court and the EU executive both ruled that this was insufficient. Babiš confirmed last month that he was once more the exclusive proprietor of Agrofert and maintained he was “implementing measures” to prevent a conflict of interest, but refused to reveal specifics.

Governing Agreement and International Consequences

The billionaire populist has concluded a coalition agreement with two minor right-leaning groups, the ultra-conservative, pro-Russian SPD, which has advocated a referendum on exiting the EU, and the Motorists for Themselves, which has primarily opposed the EU’s Green Deal.

The incoming administration, if confirmed, is expected to strengthen the populist bloc in the region and could strain western support for Ukraine – even though Babiš has called Ukraine’s leader, Volodymyr Zelenskyy, to assure him of Czech support.

Pavel, who as president has a role for international relations, also requested that the government agenda include a declaration on the official stance on the conflict in Ukraine, with a pledge to fulfilling alliance duties.

The president has earlier stated he would not endorse any ministerial nominees who might question the nation's international alliances, a requirement that the ultra-conservative party has indicated it will meet by nominating non-partisan experts.
