Federal Judge Orders Release of Abrego Garcia from Immigration Detention

A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement lacks legal authority.

"Since Abrego Garcia's return from wrongful imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her order.

The case originates in a mistaken removal to El Salvador in March, which the government later acknowledged was an mistake. After his repatriation to the United States to answer alien smuggling allegations, he was detained in federal detention.

In her order, the judge pointed out that the authorities does not have a current deportation order, which prevents them from removing Mr. Abrego Garcia "at this juncture."

The legal proceedings involve disputed claims. While the former administration contends that Abrego Garcia is a affiliate of the MS-13 criminal organization, he categorically disputes this allegation.

He has also entered a not guilty plea to the smuggling charges, which are part of a ongoing criminal case in the state of Tennessee.

The court, who was hearing his challenge to removal in a Maryland district court, ruled that he must now comply with the conditions of his release from jail in Tennessee. This order effectively transfers his supervision to the jurisdiction handling his criminal case.
