Michael Jordan Tells Court He ‘Wasn’t Afraid’ of Nascar in Legal Battle

The basketball icon, introducing himself formally in a federal courtroom on Friday, stated that his competitive side and status as a newcomer motivated his push for 23XI Racing to “challenge” Nascar over alleged violations of competition laws.

Financial Stakes and a Competitive Drive

Jordan shared financial and corporate details of his racing venture, revealing he put in $40 million of his personal wealth into the Nascar Cup series team co-founded with business partner Curtis Polk and driver Hamlin.

“Someone had to step forward,” Jordan said in the Charlotte courtroom. “I was a new person, I had no fear. I believed I could take on Nascar as a whole. I felt as far as the sport required examination from a different view.”

The Core Dispute: Charter Agreements and Renewal Demands

At issue is the end of a 2016 deal where Nascar granted each team a franchise. This system mirrors other major leagues with independent franchises, like the NBA’s Hornets or the NFL’s Panthers. This deal was due to end in 2024 when Nascar demanded charter membership renewals.

Jordan testified for about sixty minutes and exited the courthouse to a media frenzy, with onlookers and reporters clamoring for a view or a picture of the global icon.

Spearheading the Fight

23XI Racing is leading the full-court press along with Front Row Motorsports for Nascar to overhaul a operating model Jordan said is breaking the law to maintain excessive control.

At issue for Jordan and Heather Gibbs, who testified before Jordan, are details from last September. She recounted a frantic and emotional period where the racing circuit informed teams they must sign a charter agreement extension. This agreement spanned 112 pages outlining pay for chartered teams and a guaranteed entry in Nascar-sponsored races.

Choosing Litigation

Jordan said that his team and its ally concluded their sole viable path was to refuse a signature that extensive document and litigate the matter. The other 13 organizations signed the agreement.

Jordan and co-owner Denny Hamlin reached out to Nascar about potential amendments or negotiations. Nascar wasn’t talking, Jordan said.

The Bottom Line: Winning

But in the end, the pushback against what he saw as a unsustainable system was driven by the usual bottom line for Jordan: Winning.

“Hamlin persuaded me adding a third car boosted our odds of winning,” he testified, noting that he bought a third charter last year for $28m amid the legal dispute. “So I dove in.”

Heather Gibbs’ Testimony

Gibbs described her request for permanent charters, which she said a written letter to Nascar. She testified the pressure of the signature deadline was problematic.

She said, Joe Gibbs first attempted to call and talk Nascar out of demanding signatures, but CEO Jim France declined the request.

“Don’t do this to us,” Heather Gibbs said was the message to Nascar’s executives. The response was, “Whether I have 20 charters, I have 20. If there are 30, that’s the number.”
